General conditions for suscribers
Welcome to Alps4pros. Alps4pros provides its services to you, subject to the following Terms of Services (« TOS »), which may be updated by us from time to time without notice to you.
Article 1: Registration
To have access to www.alps4pros.com, you need a subscription.
In consideration of your use of www.alps4pros.com, you agree to:
- provide true, accurate, current and complete information about yourself as prompted in the registration form,
- maintain and promptly update your data to keep it true, accurate, current and complete.
If you provide any information that is untrue, inaccurate, not current or incomplete, Alps4pros has the right to suspend or terminate your account and refuse all current and future access to the website.
Article 2: Privacy policy
Registration data and certain other information about you are subject to Alps4pros’ privacy policy.
We remind you that, according to the French Law #78-17 January 6th 1978, called “Loi Informatique et Liberté”, you have the right to refer, to change and to remove personal data.
Article 3: Member account
You will receive a password and account designation upon completing the Alps4pros registration process. You are responsible for maintaining the confidentiality of the password and account and for all actions that could be done under your account. You agree to:
- immediately notify Alps4pros of any unauthorized use of your password or account or any other breach of security,
- ensure that you will exit from your account at the end of each session.
Alps4pros cannot and will not be liable for any loss or damage arising from your failure to comply with is article.
You acknowledge, consent and agree that Alps4pros may access, preserve and disclose your account information if required to do so by law or in good faith belief that such access preservation or disclosure is reasonably necessary to:
o comply with legal process,
o enforce the TOS,
o respond to claims that any content violates the rights of third-parties,
o respond to your request for customer service
o protect the right, property, or personal safety of Alps4pros and its users.
Article 4: Member conduct
Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the country in which you reside.
Article 5: Indemnity
You agree to indemnify and hold Alps4pros, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of content you submit, post, transmit or make available through www.alps4pros.com, your connection to www.alps4pros.com, your violation of the TOS, or your violation of any rights of another.
Article 6: No resale of service
You agree to not reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of www.alps4pros.com, use of www.alps4pros.com, or access to www.alps4pros.com.
Article 7: Modifications to service
Alps4pros reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, www.alps4pros.com with or without notice. You agree that Alps4pros shall not be liable to you or to any third party for any modification, suspension or discontinuance of www.alps4pros.com.
Article 8: Termination
You agree that Alps4pros may, under certain circumstances and without prior notice, immediately terminates your account. Such termination shall be the consequence of violation of the TOS or other incorporated agreements or guidelines, or for extended periods of inactivity. Alps4pros can also stop at any time online supply of www.alps4pros.com.
Article 9: Dealing with advertisers
Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through www.alps4pros.com, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that Alps4pros shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on www.alps4pros.com. You agree to respect the general sales conditions and the company regulation of each advertiser.
Article 10: Links
www.alps4pros.com may provide, or third parties may provide, links to other websites or resources. Because Alps4pros has no control over such sites and resources, you acknowledge and agree that Alps4pros is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that Alps4pros shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
Article 11: Disclaimer of warranties
You expressly understand and agree that:
- your use of the service is at your sole risk. The service is provided on an “as is” basis. Alps4pros expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Alps4pros makes no warranty that:
- www.alps4pros.com will be uninterrupted, timely, secure, or error-free,
the result that may be obtained from the use of www.alps4pros.com will be accurate or reliable,
- the quality of any products, services, information, or other material purchased or obtained by you through www.alps4pros.com will meet your expectations
o Any material downloaded or otherwise obtained through the use of www.alps4pros.com is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
o No advice or information, whether oral or written, obtained by you from Alps4pros or through or from www.alps4pros.com shall create any warranty not expressly stated in the TOS.
Article 12: Limitation of liability
You expressly understand and agree that Alps4pros shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Alps4pros has been advised of the possibility of such damages), resulting from:
o a product or service not in accordance, of which the advertiser is responsible.
o the use or the inability to use www.alps4pros.com,
o the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from www.alps4pros.com,
o unauthorized access to or alteration of your transmission or data,
o statements or conduct of any third party on www.alps4pros.com,
o any other matter relating to the www.alps4pros.com.
Article 13: Notice
Alps4pros may provide you with notices, including those regarding changes to the TOS, by either email, regular mail, or postings on www.alps4pros.com. Alps4pros also keeps the right to modify the TOS of www.alps4pros.com.
Article 14: Trademark
Alps4pros, Alps Executive Class, AEC and the Alps4pros, Alps Executive Class, AEC and ETL Development International logos are trademarks and service marks of ETL Development International.
Without ETL Development International prior permission, you agree not to display or use in any manner the trademarks named above.

Article 15: General information
The TOS constitute the entire agreement between you and Alps4pros and govern your use of www.alps4pros.com, superseding any prior agreements between you and www.alps4pros.com. The failure of Alps4pros to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and in other provisions of the TOS remain in full force and effect.
The TOS and the relationship between you and Alps4pros shall be governed by the laws of France and all dispute will be submit to the sole courts of Annecy.
